Our High Maintenance Customer (HMC) policy (POLICY 20) has been updated to be a little more transparent. Prior to this update, it mentioned taking action from a range of consequences. The updated policy specifically states what actions are affected when you get flagged as HMC.
You don't just randomly get marked as a HMC. You would get an official email or talking to from either myself or someone above me, such as feedback. You would get an outline of what behavior caused this decision.

I confess that I don't think I have ever read any of the policies in place and certainly didn't know that the HMC policy existed. I read it for the first time a moment ago.
As this policy (or the element of this policy if it is an updated policy rather than a new one) adds clarity regarding the actions / behaviour of a player that would result in the designation of HMC status, can I assume that this policy will be applied with regard to any such actions / behaviour from the date of this clarification?
It would seem to fly in the face of natural justice to declare someone a HMC (whether through email or through conversation) based on actions / behaviours BEFORE the update of the policy, especially as the reason for the update is to add transparency.
In simple terms, can you confirm that the policy will apply to all future conduct / behaviour and not be applied retrospectively with regard to past conduct / behaviour (predating the clarification of the policy) that, had this policy been as transparent then as it now is, would not have been carried out.

If I am reading Wyrom's post correctly, the HMC policy isn't anything new. It simply now clarifies what the impact is when you are flagged as an HMC.

That's correct the HMC policy has been around for a LONG time.

The HMC policy has been in affect since 2001. Nothing has changed about that. POLICY 20 is just clarifying what happens when you are HMC.
Typically, behavioral patterns are watched and a case is opened and brought to the senior staff members. If approved, a senior staff member will discuss this with you in game. If this situation is taken up the chain, it will fall to me to notify the player. And if someone takes it over me or if it involves onsite, it will be handled by Feedback.
